Deadline for PCT national phase entry in Mongolia
The time limit for Mongolian PCT national phase entry is 31 months from the priority date. The restoration of the priority right is not possible.

Filing requirements in Mongolia
The official language of Mongolian patent application is Mongolian. If the complete translation was not filed at the time of Mongolian national phase entry, it may be submitted within 2 months from the invitation of the Patent Office along with the payment of an extra fee. If a PCT application is amended, both initially filed and amended versions together with any statement under PCT Article 19 must be provided to the Patent Office in the Mongolian language.
To obtain the date of filing a PCT national phase patent application in Mongolia should contain:
- applicant’s and inventor’s details;
- international application materials;
- proof of payment of the corresponding fees.
The legalization of the Power of Attorney is not required. A scan copy thereof should be submitted at the time of filing of the application. In case of late filing of the document, additional charges are applied.
If the applicant is not an inventor, the Assignment Deed should be submitted at the time of filing of the application. In case of late filing of the document, additional charges are applied.

Examination of a PCT national phase patent application in Mongolia
PCT applications in Mongolia undergo both formal and substantive examination. A request for substantive examination (substantive search) must be filed within 15 months from the date of national phase entry of the patent application in Mongolia.
There is no novelty grace period stipulated for inventions in Mongolia.

Grant, validity term and maintenance fees
The validity term of Mongolian patents is 20 years from the international filing date. The official grant fee together with the maintenance fees for the first five years shall be paid in a lump sum within 6 months from the date of the decision to grant a patent. Next maintenance fees for subsequent years shall be paid within 6 months before the anniversary of the registration date. It is possible to pay the annuity fee within a six-month grace period after the due date together with a corresponding surcharge.

Duration of registration procedure
The average processing time for patent registration procedure which has entered the PCT national phase in Mongolia is 12-24 months.
Inventions may also be protected as utility models in Mongolia, which are subject to formal and substantive examination. The validity term of a utility model is 10 years from the international filing date and may not be extended. The annuities for the 1st–10th years of validity must be paid in full within 30 days from the date of issuance of the decision of registration.
