Fees associated with filing patent applications in Mongolia as well as other patent fees are available in the fee calculator.

• Term for filing a patent application in Mongolia

The term for filing a patent application claiming conventional priority in Mongolia is 12 months from the priority date. The restoration of said term is not stipulated in Mongolia.

• Filing requirements in Mongolia

The official language of the Mongolian patent applications is Mongolian. All necessary documents, including the translated specification, must be submitted simultaneously with the application, and non-compliance with this requirement will result in necessity of an additional fee payment.

To obtain a filing date, it is necessary to provide the Intellectual Property Office of Mongolia with the following:
- a request to grant a patent;
- description of an invention;
- patent claim(s);
- drawings (if any);
- proof of payment of the prescribed fees.

If priority is claimed, a certified copy of the Priority Document should be submitted at the time of filing of the application. In case of late filing of the document, additional charges are applied.

The legalization of the Power of Attorney is not required. A scan copy thereof should be submitted at the time of filing of the application. In case of late filing of the document, additional charges are applied.

If the applicant is not the inventor, a scan copy of the Deed of Assignment should be submitted at the time of filing of the application. In case of late filing of the document, additional charges are applied.

• Examination of the Mongolian patent application

The Mongolian patent application undergoes both formal and substantive examination. A request for substantive examination must be filed within 15 months from the date of filing of the patent application in Mongolia.

• Novelty grace period

There is no novelty grace period stipulated for inventions in Mongolia.

• Grant, validity term and maintenance fees

The validity term of Mongolian patents is 20 years from the filing date. The maintenance fees for the first five years shall be paid in a lump sum within six months from the date of the decision to grant a patent. All subsequent maintenance fees shall be paid within six months before the deadline. It is possible to pay the annuity fee within a six-month grace period after the due date together with a corresponding surcharge.

• Duration of registration procedure

It takes an average of 18 months from filing up to grant of a patent in Mongolia.

• Utility Model

Inventions may also be protected as utility models in Mongolia, which are subject to formal and substantive examination. The validity term of a utility model is 10 years from the filing date and may not be extended. The annuities for the 1^st–10^th years of validity must be paid in full within 30 days from the date of issuance of the decision of registration.

• Representation by a patent attorney

It is highly recommended for foreign applicants to appoint a Mongolian registered patent attorney to represent them before the Patent Office.
