• Multiple design applications

Multiple design applications are possible in Mongolia. However, the number of designs must not exceed 50.

• Filing requirements of a design application in Mongolia

The official language of the industrial design prosecution before the Mongolian Intellectual Property Office is Mongolian. The Mongolian translation should be provided at the time of filing of the application. In case of late filing of the translation, additional charges are applied.

For obtainment of a filing date, an industrial design application in Mongolia shall contain the following:
- request for registration of аn industrial design;
- applicant’s details;
- drawing(s) of the industrial design;
- a description of the design;
- proof of payment of the prescribed fees.

The legalization of the Power of Attorney is not required. A scan copy thereof should be submitted at the time of filing of the application. In case of late filing of the document, additional charges are applied.

A certified copy of the Priority Document should be submitted at the time of filing of the application. In case of late filing of the document, additional charges are applied.

The term for filing an industrial design application claiming conventional priority in Mongolia is 6 months from the priority date. The restoration of the priority right is not possible.

• Examination of a design application in Mongolia

A design application in Mongolia undergoes both formal and substantive examinations. No specific request is required.

• Novelty grace period

The novelty grace period in Mongolia is not applicable.

• Grant, validity term and design renewal fees

Validity term of the patent for the industrial design in Mongolia is 15 years from the filing date. No extension is possible. The maintenance fees for the first five years shall be paid in a lump sum within 6 months from the date of the decision to grant a patent. Annuities for subsequent five-year periods shall be paid within 6 months before the anniversary of the registration date. Late payment is possible within a six-month grace period by paying a corresponding surcharge.

• Duration of registration procedure

The average processing time from filing till registration of an industrial design in Mongolia is 12 months in case of a smooth procedure.

• Representation by a patent attorney

It is highly recommended for foreign applicants to appoint a Mongolian registered attorney to represent them before the Intellectual Property Office.
