Term for filing a patent application in Algeria
The term for filing an application claiming conventional priority in Algeria is 12 months from the priority date. It is not possible to restore the priority right and file the application after the 12-month term.

Filing requirements in Algeria
The application can be filed in French and Arabic. If originally filed in French, the translation into Arabic must be submitted within 60 days from the date of request by the Office. If originally filed in Arabic, the translation into French must be submitted within 60 days from the date of request by the Office. Correspondence between the Office and the applicant is conducted in French only.
To obtain the date of filing, it is necessary to provide the INAPI with:
- request which identifies the applicant and his intention to obtain a patent;
- the specifications, abstract, claims, sequence listing and drawing, all presented in Arabic;
- the legal form of the applicant;
- the nationality of the inventors.
A certified copy of the Priority Document alongside a verified French or Arabic translation should be submitted to the Algerian Patent Office within three months from the filing date.
Simply signed original Power of Attorney should be furnished within two months from the date of filing.
If the applicant is not an inventor, an application should be accompanied by the declaration justifying the applicant’s right to the invention.

Examination of an Algerian patent application
Patent applications are subject to formal examination only. However, International Search Report (if any) will be considered by the Algerian Patent Office.
The novelty grace period stipulated by the Algerian legislation constitutes 12 months prior to the date of filing or priority date if the disclosure was made by the applicant or their predecessor in title, or resulted from a third party’s abuse in respect of the applicant or their predecessor in title.

Grant, validity term and maintenance fees
The grant fee is payable at the time of filing. Patents in Algeria are valid for 20 years from the date of filing. Annual maintenance fees are due on the anniversary of the filing date. Late payment is possible within a six-month grace period, surcharge applies.

Duration of registration procedure
In case the prosecution process goes smoothly, it takes an average of five years to obtain a patent in Algeria.
It is not possible to obtain utility model protection under the current IP legislation in Algeria.
