• Multiple design applications

Multiple design applications are possible in Azerbaijan.

• Filing requirements of design application in Azerbaijan

The term for filing industrial design applications claiming priority in Azerbaijan is 6 months from the priority date. The term can be extended for 2 months if the applicant fails to file the application for reasons beyond his control.

The official language of proceedings before the Azerbaijani Trademark Office is Azerbaijani. A request to grant a design patent must be submitted in Azerbaijani language. In case all the remaining documents are filed in any other language the translation thereof must be provided within 2 months from the filing date.

For obtainment of a filing date, an industrial design application in Azerbaijan shall contain the following:
- a request to grant a design patent;
- drawings;
- description in any language.

A certified copy of the Priority Document should be provided within 3 months from filing the application.

A signed and stamped Power of Attorney  should be provided within 2 months from the date of filing in Azerbaijan. A Power of Attorney should be stamped regardless of whether the applicant is a natural or legal person. In case of absence of the stamp notarization is required.

• Examination of a design application in Azerbaijan

The Patent Office conducts optional substantive examination at the applicant’s, or any interested party's request submitted within 18 months from the filing date of an application. Alternatively a patent will be issued at the applicant’s responsibility.

• Novelty grace period

If the information on the design is disclosed by the applicant, designer and a third party, that directly or indirectly obtained said information from them, within 6 months before the date of filing, such disclosure does not disprove the novelty of a design.

• Grant, validity term and design maintenance fees

Official grant fee, as well as first post-grant annuities, should be paid within 2 months from the expiry of the term to file oppositions against published applications. The term for filing oppositions is 6 months from publication of the application. The validity term of an industrial design patent in Azerbaijan is 10 years from the date of filing which may be renewed for 5 additional years. Annuities are due starting from the third year from the filing date, but are to be paid only after registration. Subsequent annual maintenance fees should be paid in advance before the anniversary of the filing date. Late payment is possible within 12-month grace period by paying a corresponding surcharge.

• Duration of registration procedure

In the case of a smooth prosecution procedure, design registration process takes approximately 1,5-2 years in Azerbaijan.

• Representation by a patent attorney

Foreign applicants residing outside Azerbaijan must perform an industrial design prosecution in Azerbaijan through an agent, registered in Azerbaijan patent attorney.
