USA: upcoming trademark fee increase

On January 14, 2017, the USPTO will implement the revised trademark fees. We would like to highlight some important amendments in the fee schedule.

The changes will mainly affect paper filing fees for trademark registration in the US. Thus, the paper-based filing fee will be increased from 375 USD to 600 USD. The renewal fee will constitute 500 USD instead of the current 400 USD. Filing a Statement of Use will cost 200 USD instead of 100 USD while the fee for filing an affidavit of use under Section 8 of the Trademark Act will be raised from 100 USD to 225 USD.

Electronic filing fees are subject to some changes as well. The fee for filing an application is increased from 325 USD to 400 USD. Filing an affidavit of use under Section 8 of the Trademark Act will cost 125 USD instead of 100 USD. The fees for renewal and filing a Statement of Use remain unchanged.

The prevailing tendency of the introduced changes is significant fee increase (by up to 100%). The only fee that is reduced is the fee for extension of time for filing a Statement of Use through the TEAS Regular (from 150 USD to 125 USD) though the paper-based fee for the same service will be increased from 150 USD to 225 USD.
