UAE: new patent provisions

With reference to the notification by our partner JAH & Co. IP, IP-Coster team would like to inform our colleagues and clients about new patent provisions in the United Arab Emirates as of June 20, 2017.

Firstly, formal requirements should be met within 90 days from the filing date of a patent application. To restore said term it is necessary to pay a restoration fee.

The fee for substantive examination is to be paid within a 90-day period from receipt of the corresponding notification by the UAE Patent Office. In the event of failure to make payment within said period the application lapses and the applicant has to pay a restoration fee.

Patent annual fees are due before the anniversary of the filing date/international filing date of the application. Said fees may be paid within three months after the due date without any surcharge or within a further three-month period with a surcharge. It is also possible to restore a lapsed patent by paying a restoration fee.
