Serbia: Amendments to the Design legislation

With the aim to comply with the rules applicable in the EU and to eliminate deficiencies that have resulted in different interpretations of the law, the Serbian Parliament enacted the Bill amending industrial design law. The amended law entered into force on May 30, 2015.

Mainly, said amendments introduced the changed terminology which should provide more accurate interpretation of the Law. Amended Law also defines new validity term of industrial design in Serbia. The new term is 5 years from the filing date, which may be extended by the owner’s request for 5-year periods up to a maximum of 25-years term. Previously, the term of design protection constituted 25 years with the annual payment of the maintenance fees.

Also the requirement for description of the industrial design was simplified. From now it must contain the precise description only of the elements which are new and have not been available to the public. While previously, the description must contain each and every applied feature of the industrial design.
