  • Multiple-class applications

Multiple-class trademark applications are possible in Uzbekistan.

  • Filing requirements for a trademark in Uzbekistan

- A request for registration of a trademark;
- representation of the claimed trademark;
- a list of goods/services for which registration is sought in accordance with the Nice Classification;
- the document, confirming the payment of the filing fee.

  • Priority document

A certified copy of the priority application and its Uzbek or Russian translation should be provided within three months from the date of filing.

  • Requirements to the Power of Attorney

A simply signed copy of the Power of Attorney, containing the applicant’s address, should be provided at the time of filing the trademark application, along with the application itself.

  • Opposition period

There is no official procedure for filing oppositions in Uzbekistan. However, third party observations against trademark registration may be filed during the whole examination procedure before the decision is taken by the Patent Office.

  • Grant, validity term, and trademark renewal

Official fee for registration, publication, issuance of a certificate and maintenance of the first validity period of the certificate should be paid within three months from the date of forwarding a decision to grant a trademark certificate. A trademark in Uzbekistan is valid within ten years from the filing date and may be renewed every ten years. A renewal request should be submitted within the last year of the current validity term. The trademark may be also renewed within six months after the renewal due date.

  • Use requirement

The validity of a trademark in Uzbekistan can be cancelled earlier partially or entirely based on the court decision which was accepted at the request of the interested person provided that the trademark was not used continuously within the last five years.

  • Representation by a trademark attorney

For foreigners, it is necessary to perform the trademark prosecution in Uzbekistan through an agent, a registered Uzbek trademark attorney.

  • What can be registered as a trademark in Uzbekistan

Figurative, verbal, 3-dimensional and other elements or their combinations in any colour or combination of colours may be registered as a trademark in Uzbekistan.

2. Application should be filed in the name of one applicant only in Uzbekistan.
3. Response to the provisional refusal of international trademark registration must be filed within six months from the date of notification of provisional refusal. This time limit can be extended up to 6 months. Response can be filed in Russian or Uzbek. It is necessary to appoint a local representative for filing the response and/or requesting a time extension. Final refusal may be appealed within 3 months after its issuance.
