• Term for filing industrial design application in Uzbekistan

The deadline for filing an industrial design application claiming priority is six months from the date of priority. The term can be extended for two months.

• Multiple design application

Multiple design applications are possible in Uzbekistan if the designs concern the same object or may be identified as a kit of goods and have a single design concept.

• Filing requirements for design applications in Uzbekistan

- a request to grant a design patent containing information about the applicant(s) and designer(s);
- a set of drawings;
- a description of the design.

• Priority document

A certified copy of the priority application and its translation into the Uzbek or Russian language should be submitted to the Patent Office within three months from the date of filing.

• Power of Attorney requirements

A simply signed Power of Attorney should be submitted at the time of filing in case the applicant is a natural person. If the applicant is a legal entity, a signed and stamped Power of Attorney should be provided to the Uzbek patent Office upon filing the design application. No notarization or legalization is required.

• Examination of an industrial design in Uzbekistan

Substantive examination has to be requested within three months from the date of issuance of Official Notification about the positive decision of the formal examination.

• Grant and validity term

Official fees for granting should be paid within three months from the date of issuance of the decision to grant a patent. First post-grant annuities should be paid within said term as well. A patent on industrial design is valid for ten years from the date of filing the application. This term may be extended but no more than for five years.

• Novelty grace period

Disclosure of the information on an industrial design within six months before the filing of the application does not disprove the novelty of the industrial design according to the Uzbek legislation.

• Representation by a patent attorney

For foreigners, it is necessary to perform an industrial design prosecution in Uzbekistan through an agent, a registered Uzbek patent attorney.
