  • Multiple classes

Multiple-class trademark applications are possible in Thailand.

  • Minimum of filing documents in Thailand 

To obtain the date of filing the trademark application in Thailand must contain at least the following:
- name, address, country of residence of the applicant;
- a sample of the trademark;
- list of goods/services.

  • Requirements to the Power of Attorney

An original of the power of attorney should be submitted for an appointment of the representative. POA must be provided to the trademark office simultaneously with filing the trademark application in Thailand or within 90 days by paying a corresponding surcharge.

  • Priority document

To confirm the priority right, a certified copy of the priority application/registration together with its English translation and a letter confirming that this application/registration has not been abandoned or cancelled before priority is claimed must be provided along with the application. Late submission of the priority document within a 60-day term is allowed at no additional cost.

  • Opposition period

Opposition period constitutes 60 days from publication of the Thai trademark application in the official gazette.

  • Grant, validity and renewal

The official fee for granting a certificate should be paid within 60 days from the corresponding invitation of the trademark office. Trademark registration in Thailand is valid for ten years from the date of filing, which is renewable for the same time periods an unlimited number of times. Request for the renewal of a trademark must be filed within 90 days before the expiration of the current validity term or within 6 months after registration expiration date by paying 20% surcharge. The grace period for late renewal is not stipulated.

  • Use requirement

A third party may file a request for cancellation of trademark registration in Thailand. Registration may be cancelled if the trademark has not been used within three years before the third party files a request for said cancellation.

  • Representation by a trademark attorney

For foreigners, it is required to appoint an agent, a registered trademark attorney in Thailand for trademark registration.

2. The time limit to file a response to the provisional refusal of an international registration in Thailand is 90 days from the date the Office issues the provisional refusal. There are no extensions. The language of the response is Thai. For foreign applicants, it is necessary to appoint a local representative for filing of the response.
