  • Design fees

Fees associated with filing industrial design applications in Thailand, as well as other design fees, are available in the fee calculator.

  • The term for filing design application in Thailand

Filing the industrial design application claiming priority is possible within six months from the priority date. The restoration of this term is not stipulated.

  • Minimum of filing documents in Thailand

To obtain the date of filing the design application in Thailand must contain:
- title of a design, full name(s) and address(es) of the applicant(s) and designer(s);
- drawing of design (7 sets) executed according to the formal requirement of the Thai legislation;
- if the priority is to be claimed, particulars of a priority application.

  • Multiple design applications

Under Thai regulation, a multiple design application is not allowed. Each embodiment of the design is deemed to be a separate design application.

  • Power of Attorney requirements

The notarized Power of Attorney must be provided after filing the application, i.e. within 90 days; however the surcharge for late filing must be paid.

  • Priority document

To confirm the priority right, the applicant must submit the certified copy of the priority document before the publication of a design application in the official gazette.

  • Additional documents

If the applicant is not the designer, the original and notarized Deed of Assignment must be provided simultaneously with filing or within 90 days by paying the fine. If the applicant is the designer, the Statement of Applicant’s Rights must be provided within the same time limits. Notarization is not required.

  • Examination of a design application in Thailand

The design application in Thailand undergoes the substantive examination automatically, i.e. without the filing of the specific request or payment of examination fees.

  • Grace period

There is no provision for novelty grace period in the Thai design regulation. The design which has been disclosed to the public before filing the application is not patentable in Thailand.

  • Validity term and maintenance fees

The industrial design registration in Thailand is valid for ten years from the date of filing. The first maintenance fees must be paid at the beginning of the 5th year of the patent validity term. If the design patent is granted at the beginning of the 5th year, the maintenance fees must be paid within 60 days from the patent grant.

  • Representation by a patent agent

For foreigners, it is required to appoint a certified patent agent in Thailand for filing industrial design applications.
