  • Multiple-class applications

Multiple-class trademark applications are possible in Peru.

  • Minimum filing requirements in Peru

For obtainment of filing date the trademark application shall contain the following:
- request for trademark registration;
- information about the applicant;
- representation of the trademark;
- an indication of the goods and services for which the registration is sought;
- proof of payment of the filing fee.

  • Requirements to the Power of Attorney

A copy of a simply signed Power of Attorney must be submitted within 60 business days from filing a trademark application in Peru. Legalisation or notarization is not required.

  • Priority document

If the priority is being claimed, a certified copy of the priority document translated into Spanish must be filed within nine months from the priority date.

  • Opposition period

An opposition may be submitted within a term of 30 business days from the publication of the application. If an opposition is filed, the applicant is given additional 30 days for the response.

  • Grant, validity term and trademark renewal

Grant fee is not stipulated. The registration of a trademark shall have a term of 10 years from the date of grant and can be renewed for successive ten years. A renewal request may be filed within six months before the expiration of the validity term. It is possible to renew a trademark within six months after the expiration date without payment of extra fees. To renew a trademark, a Power of Attorney is required.

  • Use requirement

Registration of the trademark may be cancelled on the grounds of non-use in any country of the Andean community within three years from the registration date.

  • Representation by a trademark attorney

For foreign applicants, it is necessary to perform trademark registration in Peru through an agent (any natural or legal person residing in Peru). It is recommended to use services of a registered Peruvian trademark attorney to facilitate the registration process.
