Fees associated with filing industrial design applications in Peru, as well as other design fees, are available in the fee calculator.

• The term for filing a design application in Peru

The application on industrial design claiming priority must be filed within the non-renewable term of 6 months from the priority date.

• Minimum filing requirements in Peru

For obtainment of the filing date the industrial design application shall contain the following:
- request for industrial design registration;
- information about the applicant and the author;
- representation of the industrial design;
- proof of payment of the prescribed fee.

• Multiple design applications

According to Peruvian legislation, it is not possible to file several designs in a single design application.

• Power of Attorney requirements

A copy of a simply signed Power of Attorney must be submitted within 30 days from the filing date. Legalisation or notarization is not required.

• Priority document

If the priority is being claimed, a certified copy of the priority document and its Spanish translation must be filed within nine months from the priority date.

• Examination of a design application in Peru

Formal examination of a design application in Peru is performed within 15 days following the filing date. The Patent Office Authorities shall not conduct an examination ex officio of the novelty of the subject matter if no opposition is filed based upon the existence of a prior right or the novelty of the industrial design. However, if the lack of novelty of an industrial design is obvious, the Authorities shall reject the application ex officio.

• Novelty grace period

Novelty grace period in Peru constitutes one year prior to the date of priority. It applies if the design was disclosed by the designer or the designer's assignee, national office or a third party who obtained the information directly or indirectly from the designerr or its assignee.

• Grant and validity term

There is no official grant or maintenance fee in Peru. Validity term of the patent for industrial design in Peru comprises ten years as of the filing date.

• Representation by a patent attorney

For foreign applicants, it is necessary to perform patent registration in Peru through an agent (any natural or legal person residing in Peru). It is recommended to use services of a registered Peruvian patent attorney to facilitate the registration process.
