Filing requirements in Lithuania
The official language of the proceedings before the Lithuanian patent office is Lithuanian. An application should be filed in Lithuanian. Accompanying documents may be filed in any language; however, the translation thereof into Lithuanian should be submitted within two months from the filing date.
To obtain the filing date, it is necessary to submit:
- request to register a trademark;
- information identifying an applicant and his representative;
- a reproduction and description of the mark;
- list of goods and/or services in accordance with the Nice Classification valid as of the date of filing the application;
- the document confirming payment of the official filing fee.
A certified copy of the Priority Document should be provided either at the time of filing of the application or within three months from the filing date.
The original of a signed Power of Attorney, containing the applicant’s address, must be provided to the Lithuanian trademark office within three months from the date of filing of the trademark application.

Examination, publication and opposition to a trademark application in Lithuania
Trademark applications in Lithuania are examined for compliance with formal requirements and checked for any absolute grounds for refusal or invalidity. No prior search is conducted by the office. An application is published upon successful examination. Within three months following the publication of the application, interested parties may object by filing a reasoned written opposition with the Appeals Board.
Trademarks in Lithuania are valid for 10 years from the filing date. Trademark registration may be renewed by the rights holder for a 10-year period unlimited number of times. A request for renewal should be filed within the last six months of the trademark validity. Late payment is possible within a period of six months after expiration of the validity term by paying a 50% surcharge. Reinstatement of a lapsed trademark after a six-month grace period is not possible.

Approximate time from filing to registration of a trademark in Lithuania is 6-7 months.
In case a trademark has not been used within a period of 5 continuous years after registration it may be subject to cancellation.

Representation by a trademark attorney
For foreign applicants not residing in EEA (European Economic Area), it is necessary to perform trademark registration through an agent, a registered Lithuanian patent attorney.

2. Trademark protection in Lithuania may also be obtained via registration of European Union Trademark.
3. Response to the provisional refusal of international trademark registration must be filed within three months from the date of the decision. This term can be extended for one month by paying a relevant fee, but there is no possibility of its reinstatement. The language of the response is Lithuanian. A local representative must be appointed for filing the response. Final refusal may be appealed within 2 months from sending a decision on re-examination. This term can be extended for one month by paying a relevant fee, but there is no possibility of its reinstatement.
