  • Term for filing the design application in Romania

The deadline for filing industrial design application in Romania, claiming priority is six months from the date of priority date. It is not possible to restore this term.

  • Filing documents in Romania

The industrial design application in Romania should contain:
- applicant's data;
- number of designs for which protection is claimed;
- an indication of the products which incorporate the design, if appropriate;
- description of the novel characteristic elements of the design for which protection is claimed, as they appear in the filed graphic representations;
- authors' names or a statement on the applicant's responsibility in case when the authors have waived their right of being mentioned in the application and/or the design publications;
- graphic representations of the design.

  • Multiple design application

A multiple design application including maximum 100 designs is permitted in Romania if the designs meet a condition of unity of design, a unity of production and unity of use, or shall belong to the same set or composition of items.

  • Validity term

The industrial design registration in Romania is valid for ten years from the filing of the application and may be renewed additionally three times for five years period.

  • Examination of a design application in Romania

The Romanian patent application undergoes the formal and the substantive examination. Examination of an industrial design application in Romania is conducted within 12 months from the publication of the application. No specific request from the applicant is required. 

  • Requirements to the Power of Attorney

Simply signed/stamped Power of Attorney must be provided simultaneously or within 15 days by the applicant’s request. Legalisation or notarisation is not required.

  • Priority document

To confirm the right of priority, the priority document should be submitted to the Romanian patent office within three months from filing the design application either in original or a certified copy thereof. The translation into Romanian is not necessary unless it is expressly requested by the Romanian Patent Office.

  • Grace period

The disclosure of the industrial design in Romania within 12 months before the filing of the application or its priority date, in case priority is claimed, will not be considered as disproving the novelty of the industrial design according to Romanian legislation.

  • Grant and patent maintenance

The grant fee for issuance of the registration certificate of the industrial design and the design maintenance fee are paid within one month from the date of receipt of the decision to grant for the whole period of 10 years. The renewal fee must be paid within 6 months prior to the validity term expiration. Late renewal is possible within a 6-month grace period on condition of payment of an additional fee.

  • Representation by a patent attorney

For foreigners residing outside Romania, it is compulsory to perform the industrial design prosecution in Romania through an agent, a registered Romanian patent attorney.

  • What can be registered

The appearance of a product or a part thereof, in two or three dimensions, resulting from the combination of the main features, particularly lines, outlines, colours, shape, texture and/or materials of the product itself and/or its ornamentation may be registered as an industrial design in Romania.
