Temporary legal protection for industrial designs in Russia

As of June 26, 2019, it will be possible to obtain temporary legal protection for industrial designs in Russia. The law “On amendments to Part IV of the Civil Code” was approved on December 27, 2018, coming almost a year after the introduction of the Hague system to the IP protection system in Russia.

In accordance with the new law, applicants will be afforded the opportunity to request the publication of information on their industrial designs in the official gazette. Temporary protection covers the design’s essential features as per representation and may be obtained for the period between the publication of the application and the date of grant. This option will be applicable for applications that have passed the formal examination stage. As such, the patentee will now have the opportunity to obtain compensation if any third parties have utilised the design during the period of temporary protection, provided that the industrial design has been registered.

The proposed amendments demonstrate Russia’s ongoing commitment to enhancing its intellectual property system in the ever-changing legal climate.
