European patent validation in Portugal

In Portugal, the validation and publication of European patents depend on the timely submission of a Portuguese translation, as well as compliance with local formalities, including payment of fees and appointment of legal representation.

• Translation into Portuguese

The translation of a European patent specification into Portuguese must be filed within three months from publication of the decision to grant a European Patent. The term may be extended by one month provided that a surcharge calculated with reference to the national patent filing fee is paid. The translation must be certified by a professional representative accredited by the National Industrial Property Institute.

• Validation fees

The fees associated with validation of a European patent in Portugal are available in the fee calculator.

• Maintenance fees

The due date for payment of the renewal fees for a European patent validated in Portugal is the anniversary of the filing date. Payment cannot be made more than 6 months in advance. Late payment is possible within 6 months after the due date provided that a 50% surcharge is paid.

The first annual fee in the validation year may be paid within 3 months after the filing date anniversary following the date of validation.

• Representation by a patent attorney

For foreign applicants, it is recommended to appoint a registered patent attorney for representation before the Portuguese National Industrial Property Office (INPI).
