- Deadline for the PCT national phase entry in Iran
The term of entering the PCT national stage in Iran is 30 months from the date of priority. Restoration of this term is not applicable.
- Minimum of filing documents in Iran
Minimum of filing documents in Iran for PCT national phase entry is a Power of Attorney notarised and duly legalised up to the Iranian Consulate, a copy of the international application, a certified copy of the Priority Document (if any), national phase entry fee and translation, if applicable.
- Language of the Iran patent application
The official language of the Iranian PCT application is Persian.
- Power of Attorney requirements
The original of the Power of Attorney should be notarised, legalised and submitted simultaneously with the filing of the PCT application in Iran or within 2 additional months from the filing date. The deadline for submitting the documents is 60 days from date of receiving the notice from Patent Office. Extension for two months can be obtained.
- Incorporation Certificate
If an applicant is a legal entity, a certified copy of the Incorporation Certificate with an English and Farsi translations should be submitted within 60 days from the date of receiving the notice from the Patent Office.
- Substantive examination request
The Patent Office of Iran examines patent applications for substantive grounds, checking similar/identical and prior patents filed. However, all patent applications in Iran undergo examination with a research institute or a university for novelty, industrial applicability and inventive step before patent granting. Examination with a research institute or a university starts automatically once the examination on formal requirements is completed.
- Grace period
Novelty grace period in Iran is not applicable.
- Grant and maintenance fees
The term of protection for a PCT patent in Iran is 20 years from the PCT filing date. PCT patents are subject to annuity payments from the PCT filing date and all past annuities should be paid at the time of entering the PCT national stage in Iran. The subsequent annuities are payable within 2 months before the anniversary of the international filing date. Examination fees have to be settled after the submission of all required documents. Late payment is possible within a six-month grace period after the due date by paying a corresponding surcharge.
- Representation by a patent attorney
For the foreigners, it is necessary to perform the patent prosecution based on PCT through an agent, registered Iranian patent attorney.
